As winter approaches, we realize that many families in and around the Port Huron area need a new furnace but may not have the means to purchase one. As It’s Your Heating and Cooling Guy commitment to give back to our community, provide a furnace to 1 family or individual to prepare their home for the winter with our Furnace Giveaway.

We are looking for only those who have an excellent story to share. One can nominate themselves, or someone they feel is deserving of this great gift — but all must be legal residents of the State of Michigan within a 30-mile radius from 2528 Beach Road Port Huron, Michigan 48060 in the state of Michigan. Furnace must be used for personal residences only. Nominations will be collected from November 1, 2022, through November 30, 2022.

The winner will be announced December 7, 2022 at 12:00pm (noon) On our Facebook page and our website.

ELIGIBILITY AND LIMITATIONS.

It’s Your Heating and Cooling Guy Furnace Giveaway (the “Contest”) is open only to those who sign up on our Contest page via the link from our Facebook page (itsyourheatingandcoolingguy), or directly on our website (www.itsyourheatingandcoolingguy.com, and who are 18 years old as of the date of entry. The Contest is only open to legal residents of the State of Michigan, within a radius of 30 miles from 2528 Beach Road Port Huron Michigan 48060 and is void where prohibited by law. Eligibility is limited to personal residences only. Business, multi-unit apartments, mobile homes, and rental properties are not eligible. The winner must have existing forced-air systems, no baseboard, hot water heating or Steam. Natural gas or LP fired systems only; no fuel oil. A contestant must have the following services to a house, into the mechanical room/ closet, and connected to an existing furnace: natural gas or LP gas service; and electrical service. Employees of It’s Your Heating and Cooling Guy (the “Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members, and those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, state, and local laws and regulations.

AGREEMENT TO RULES

By participating, you agree to be fully and unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the Contest-related decisions of the Sponsor as final and binding.

CONTEST PERIOD

Entries will be accepted online starting on November 1st, 2022, at 8:00 am EST and ending November 30, 2022, at 11:59 EST. All contest page and Facebook entries must be received by November 30, 2022, 11:59 EST.

HOW TO ENTER

You must enter the Contest by submitting an entry (a) using the online form provided via the link from our Facebook page (Facebook.com/Itsyourheatingandcoolingguy), (b) via the link form our website itsyourheatingandcoolingguy.com or (c) via mail to It’s Your Heating and Cooling Guy, Attn: Furnace give away 2528 Beach Road Port Huron, Michigan 48060. The entry must fully fill all Contest requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications will become disqualified at the Sponsor’s sole discretion. You may enter only once, and you must fill in the information requested. You may not enter multiple times by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, We may remove your submission from eligibility at the Sponsor’s sole discretion. If you nominate someone else, the nominee must be notified of their entry and agree to their story, and we will use your pictures for the Social Media contest.

PRIZES

There will be Two Winners! Both winners will receive a York 2 stage ECM Motor furnace or a Goodman 2 stage ECM Motor furnace including the following warranties: 1-year labor, ten years parts. In addition to having the furnace registered to the York manufacturer or Goodman Manufacturer by the Sponsor. An approximate retail value of the Prize worth up to $5,000.00. The installation covers the Sponsor’s simple installation. Actual/appraised value may differ at the time of the Prize award. The Sponsor shall solely determine the specifics of the Prize. No cash or other prize substitution will be allowed except at the Sponsor’s sole discretion. The Prize is non-transferable. Any Prize-related expenses, including without limitation all federal, state, and local taxes, shall be the sole responsibility of the winner. No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent by winners is permitted. One Prize per one winner only. The winning entries will be responsible for: additional duct system modifications (if necessary), any hazardous material removal and abatement (e.g., asbestos), and any improvements needed to bring the installation in compliance with existing building and mechanical codes such as electrical or gas lines, or chimney liners & exhaust systems (any applicable additional costs will be discussed beforehand).

ENTRY INSTRUCTIONS

You can find the entry form via the link from our Facebook page (Itsyourheatingandcoolingguy) or website (www.itsyourheatingandcoolingguy.com, which you must complete in its entirety. If you are nominating yourself, the nomination form must include: Your name, Your physical home address, Your phone number, Your valid email address, A detailed statement (5-15 sentences) explaining why you require a furnace.

If you are nominating someone else, the nomination must include: Your name, Phone number, The name of the person you are nominating, The nominee’s address and phone, A detailed statement explaining why the nominee requires a furnace, A detailed statement (5-15 sentences) explaining why you require a furnace.

JUDGING CRITERIA & SELECTION OF WINNER

The Sponsor will conduct the judging, and an internal committee will make its subsidiaries & the final decisions at It’s Your Heating and Cooling Guy. We will determine the winner based on a review by the internal judging committee. The It’s Your Heating and Cooling Guy internal judging committee’s decisions and selecting the winner are final.

WINNER NOTIFICATION

The winner’s will be notified via phone or email on the submission page of the Contest within five business days following the winners’ selection. After announcing to the winner that they have won the Prize, the Sponsor shall, not later than five days after making the notification, provide the winners with the Prize, or with a certificate, or other document giving the winners the unconditional right to receive the Prize. Suppose a winner cannot be reached after a total of 3 attempts by the Sponsor via the phone or email given on the submission form within five days of the notification. In that case, the winner will forfeit the Prize in its entirety. In addition, an alternate winner will have to be selected by the Sponsor’s judging committee.

Except where prohibited by law, a liability and publicity release, a copy of their driver’s license, or other government-issued identification to claim their Prize. The Sponsor shall have no liability for a winner’s failure to receive notices due to the winner’s spam, junk email, other security settings, or for the winner’s provision of incorrect or otherwise non-functioning contact information. The winner will be required to execute and return Sponsor a certification of eligibility, as provided and described to the winner at the time of notification. The winner must return the required documents to the Sponsor by the date and time specified in the Sponsor’s winner notification email.

Receipt of the winner of the Prize offered within this Contest is conditioned with compliance with all federal, state laws and regulations. Winner MUST complete Federal Tax form W-9 before furnace installation scheduling. ANY VIOLATION OF THESE OFFICIAL RULES BY THE WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND THE WINNER WILL IMMEDIATELY TERMINATE ALL PRIVILEGES AS THE WINNER.

PUBLICITY RIGHTS.

By entering this contest you understand that the Sponsor, anyone acting on behalf of the Sponsor, or its respective licensees, successors, and assigns will have the right, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, and use, worldwide, in any media now known or hereafter, in perpetuity and throughout the World, your entry, including, without limitation, the entry and your name, portrait, picture, voice, likeness, image, or statements about the Contest, and biographical information as news, publicity, or information and for trade, advertising, public relations, and promotional purposes without any further notice or compensation.

TERMS.

The Sponsor reserves the right, in its sole discretion to cancel, terminate, modify, or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud, or other causes beyond its control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such a case, the Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Contest Rules. The Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to, multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Contest Rules; or the use of bots, macros, scripts, or other technical means for entering.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the Contest, you, an entrant, agree to receive email communication periodically from the Sponsor. You can opt-out of receiving this communication at any time by clicking the unsubscribe link on the email.

LIMITATION OF LIABILITY

By entering the Contest, you, an entrant, agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Contest and/or his/her acceptance, receipt, possession, use, or misuse of any Prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error which may occur in the administration of the Contest or the processing of entries.

DISPUTES

This Contest is governed by the laws of Michigan, without respect to conflict of law principles. As a condition of participating in this Contest, the participant agrees that all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Michigan and having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and because of this waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

Port Huron, MI 48060. We must have all requests no later than December 31st 2021.
